В связи с этой цитатой возник другой вопрос. Если technological measure
can be easily circumvented, стало быть, она controls access ineffectively,
иными словами, only claims to control этот самый access. Следовательно, 
такая неэффективная мера не попдпадает под DMCA и не защищается им. 

Или я неправильно слово "effectively" с английского перевёл?
